After the e-Consultation, the Tourism Act before the end of September before the Government of the Republic of Croatia: a total of 235 comments

Extending the deadline for public consultation on the Draft Bill is unfortunately not possible, say MINTS, because it needs to be referred to a further legislative procedure.

The e-Consultation on the Draft proposal of the new Law on Tourism is closed.

In the month that it lasted, the Counseling collected a total of 235 comments and 15 additions to the text, and the vast majority of them arrived in the last three days duration. Namely, as we stated in our article from August 23, 2023. by then it had arrived about fifty comments, and a good part of them was actually a proposal for the extension of e-Consultation.

But it will not come to that. The consultation is closed for further comments, and the Law enters the procedure, before the Government of the Republic of Croatia, and then into parliamentary debate. The Law on Tourism should enter into force on the first day of next year.

We received a response from the Ministry of Tourism and Sports to our inquiry regarding this topic, and we are transcribing it in its entirety:

"On August 26, 2023, the eConsultation for the draft of the tourism law was completed. According to the Law on the right to access to information (Official Gazette 25/13, 85/15, 69/22), the deadline for public consultation is, as a rule, 30 days. The draft of the draft law on tourism was on public consultation from July 26 to August 26, 2023.

We take this opportunity to thank everyone who participated in the public consultation and presented their suggestions and comments. Given that the consultation has ended, the Ministry of Tourism and Sports will analyze all received proposals and prepare a report on the conducted consultation, which is scheduled to be published on the central state internet portal eConsultation on September 26, 2023.

Given that the deadline for the entry into force of this reform law is also determined by the National Recovery and Resilience Plan, the procedures and adoption at the Government session must be carried out during September, after which the Law is referred to the Croatian Parliament for its first reading. It is planned to adopt the Law in the regular procedure, that is, through two readings in the Croatian Parliament. The law should enter into force on January 1, 2024. Extending the deadline for public consultation on the Draft Bill is unfortunately not possible, since the Draft Bill needs to be sent to a further legislative procedure in order to be adopted by the Croatian Parliament by the end of the year.

During this year, as well as during the public debate, a series of meetings were held with entrepreneurs, tourist associations, representatives of counties, cities and municipalities, where the Draft Bill was presented, and a wide range of stakeholders were also involved in the working group for drafting the law.

As before, all constructive remarks which will improve the text of the proposed draft law, we will definitely consider and respect where it is applicable and possible."

Let's remind you once again that the Tourism Act regulates the tourism system, managing tourism development in the direction of sustainability, ensuring sustainability, the system of data collection, monitoring and analysis, the destination management system, the system of encouraging, monitoring and analyzing investments in tourism. All these are important items for a tourist country.

It is interesting that they were completed during the tourist season two more e-Consultations related to tourism. Both were implemented by the Ministry of Spatial Planning, Construction and State Property until August 25.

The first decree is Fr way determination of the unit rent amount for tourist land on which the hotel and tourist resort is built, the method of calculating the rent and other fees and the mandatory content of the lease agreement, and the second regulation is about determining of the initial amount of the unit rental price for tourist land in the camp, the method of calculating the rent and other fees and the mandatory content of the lease agreement.

Both e-Consultations collected, individually, less than 30 comments.
